Mediation Story:
“I don’t really care if I settle this claim or not!”
declared the Claimant while in private caucus.
The mediator responded.
“Thanks for letting me know your thoughts about settlement and perhaps we should stop our efforts. However, hearing you say that you don’t really care what happens reminds me of a story I once heard and let me share it with you.”
A young boy was walking along the beach with his grandfather and came across a large number of starfish that had been washed ashore. The boy started picking them up, wading into the water and tossing the starfish back into the sea. After about 10 minutes, with the grandfather watching, the grandfather said, “stop, can’t you see that there are too many starfish on the beach. it doesn’t matter if you keep throwing them back.”
The little boy looked at the starfish in his hand and then back at his grandfather and said – “It matters to this one.”
The mediator ended his story and sat quietly.
The claimant was silent for a moment and then spoke up. “You know, I think it does matter to me about getting this case settled today. Can we keep working on this?”

Roy Baroff began his work in the dispute resolution field in 1981 with the Orange County Dispute Settlement Center. He was trained as a mediator in 1982 and received his North Carolina Superior Court Mediator Certification in 1992. He has mediated over a thousand cases in a variety of settings over the last 25 years.
His primary focus today is mediating litigated cases in both Federal and State Court and for claims at the North Carolina Industrial Commission. He also serves as mediator for The Carolinas Center for Medical Excellence which is a quality improvement program for Medicare.
Roy serves as an Arbitrator for the American Arbitration Association Commercial Panel, for the Financial Regulatory Authority and for uninsured/underinsured claims.
He also serves as a trainer for many organizations providing mediation and leadership training in a range of settings.
Roy also provides external ombuds services to organizations seeking to enhance the resolution of workplace conflict and increase productivity and retention of employees.
